Abstract

This article establishes a theoretical framework that stresses the judge's task in his action according to the constitutional reform in human rights. We start from the principalist theory of fundamental rights, focusing on the weighted judgement. Then we analyse some of the criteria that mexican jurisprudence has established regarding the balancing of rights.
